Puppy Contract for Asiri Anatolian Shepherd Dogs

NOTE: DUE TO THE STRONG WORKING INSTINCT OF ANATOLIAN SHEPHERDS, WE PREFER TO PLACE PUPPIES IN WORKING HOMES, AS GENERAL FARM OR FAMILY GUARDIANS, OR WITH PEOPLE WHO HAVE HAD EXPERIENCE WITH LARGE WORKING BREEDS. ANATOLIANS NEED ABUNDANT SPACE AND FREEDOM TO EXERCISE AND PERFORM THE JOB THEY WERE INTENDED TO DO. WHILE THEY ALSO EXCEL AS WONDERFUL GUARDIANS AND COMPANIONS TO FAMILIES AND CHILDREN, THEY ARE NOT MEANT FOR ALL ENVIRONMENTS. WE DO NOT RECOMMEND THEM FOR CITIES, TOWNS, OR URBAN AREAS WITH SMALL YARDS, APARTMENTS OR CONDOS.

1. Buyers are absolutely required to OFA certify (hips & elbows) their pups as stated in the below contract.

2. Every puppy owner from pet to working dog, plays a part in the future and health of our breed, thus genetic info from each individual pup in the litter is important.

3. If you want a puppy & do not plan to do the prescribed health testing (OFA/thyroid/etc.) as stated in the below contract, we do not have space on the waiting list for you. We are only interested in homes that have the same interest in the wellbeing of our breed that we have.

SALES CONTRACT & HEALTH GUARANTEE



We, (names of breeders) (hereinafter designated as BREEDER), guarantee this Anatolian puppy to be healthy and free of disease upon receipt by BUYER. Every effort has been made by BREEDER to produce a litter both physically and mentally sound. BREEDER will stand behind this breeding to the extent stated below. However, BUYER accepts full responsibility for the proper care once the pup leaves the BREEDER. BREEDER cannot be held responsible for the death, injury, deformity, or temperament of the pup due to illness, accident, or deviation from adequate care and socialization required for an Anatolian Shepherd Dog.

I, (name of buyer) (hereinafter designated as BUYER), agree to have this pup examined by a licensed veterinarian within seven (7) days of receipt. If health problems are found, the pup may be returned to BREEDER at BUYER’S expense. BREEDER is to be notified and arrangements are to be made within 24 hours of diagnosis by a licensed veterinarian. If puppy is returned for health reasons, BREEDER has the right to choose to refund the purchase price or to replace the pup with one of equal quality from the same or subsequent litters. If the pup is returned for reasons other than health related issues within the allotted time, the purchase price will be refunded less the nonrefundable deposit. If negligence is suspected on BUYER’s part, BUYER forfeits all rights to the pup and all rights to reclaim any monies rendered for pup. BUYER will return all registration and documentation materials at the time of pup’s return. BREEDER is not responsible for any veterinary expenses incurred by BUYER.

IF SOLD AS COMPANION (spay/neuter contract): This dog is sold as a "Companion animal", and BUYER agrees to have this dog surgically sterilized between twenty-four (24) and thirty-six (36) months of age or, if already more than thirty-six (36) months of age, within 1 year of receipt. If BUYER chooses not to sterilize this dog and decides to breed it, BREEDER makes no guarantee as to the quality of the offspring. THIS DOG WILL BE DESIGNATED AS “LIMITED REGISTRATION” WITH AKC and the off-spring will not be eligible for registration. If this dog is not sterilized within the specified time, this contract is null and void, and ownership reverts to breeder unless previous arrangements have been made in writing from breeder.

IF SOLD AS SHOW PROSPECT: This dog is sold with the intention that it be shown in AKC conformation shows, and BREEDER guarantees that this dog has no defects (i.e., bad bite, blue eyes, etc.) that would disqualify this dog from being shown in a conformation dog show. However, the BREEDER does NOT guarantee that said dog will win in the show ring, as that must depend on the training of the dog, showmanship of the handler, and commitment of the owner. BUYER agrees to keep BREEDER apprised of dog’s progress (wins, points, etc.), along with emailing show photographs for inclusion on Breeder’s website or for any advertising of BREEDER’s kennel.

IF SOLD AS BREEDING PROSPECT: This dog is sold with the understanding that it may be used for breeding, and BREEDER guarantees that this dog has no obvious defects that would prevent the siring or whelping of healthy pups. However, this dog is considered NON-BREEDING until such time as OFA hips & elbows, thyroid and CERF examinations are performed (after reaching 24 months of age) and the dog has been certified clear of hip and elbow dysplasia, hypothyroidism and entropion. Should the dog not be certified clear of these genetic tests, BUYER agrees to sterilize the dog. NOTE: BUYER also agrees that any breeding that does take place (after genetic testing is completed and dog has been cleared) will be only to another Anatolian Shepherd Dog that has been OFA hips and elbows cleared, thyroid tested normal and tested free of entropion. If this dog is bred or sires a litter of pups before being cleared of the aforementioned genetic defects, or is bred to other than an Anatolian, this contract is null and void.

(FOR STUD DOGS): BUYER also agrees that BREEDER will be permitted to use this dog as a stud for select bitches of BREEDER’s choosing if said dog passes all of the above mentioned genetic testing. BUYER will receive second pick puppy from said litter or $800 as compensation for this service.

IF SOLD ON CO-OWNERSHIP AGREEMENT: BREEDER will remain as co-owner of dog. This entitles the BREEDER to advise BUYER regarding the breeding potential of dog and the right of ownership of dog in the event the BUYER is unable to keep the dog. Buyer also agrees to state in their will that the dog returns to BREEDER in the event of BUYER’S demise. Dog will live with and be cared for by BUYER, and BUYER will be responsible for all expenses incurred on behalf of this dog.

GUARANTEE: This dog is guaranteed to be free of hereditary hip dysplasia upon permanent radiographic evaluation performed at 24-30 months of age. BUYER agrees to have this dog's hips radiographically examined by a State licensed Veterinarian and then sent to the Orthopedic Foundation for Animals in Columbia, MO, for evaluation. Upon receipt, a copy of the evaluation will be sent to BREEDER. If hip dysplasia is diagnosed due to genetic defect, and all prerequisites have been met for the health and well being of the dog as specified in this contract, breeder will (at her discretion) either refund $500 or replace dog from another litter.

BUYER must provide written proof of hip dysplasia, and proof the dog has been sterilized. The dog does NOT have to be returned to BREEDER. If dog is not sterilized, this guarantee is null and void.

If BUYER is unable to keep this dog for any reason, BUYER agrees to return it to BREEDER or to a person stipulated by BREEDER at buyer’s expense and foregoes all rights to said dog. BUYER will return all registration and documentation materials at the time of dog’s return.

This dog may NOT be sold, transferred to another person, CO-OWNED with anyone other than those persons stipulated in this agreement, given away, placed in an Animal Shelter, or euthanized without prior written permission from BREEDER. The exception to euthanasia would be in the case of severe injury or suffering on the dog's part.

BUYER also agrees that the penalty for transferring this dog into a co-ownership agreement (as stipulated above) without written permission from BREEDER will be that ownership of said dog will automatically revert to BREEDER with no financial compensation to BUYER. BUYER is responsible for all transportation expenses to return dog to BREEDER or BREEDER's agent.

BUYER agrees to provide adequate secure fencing (at least 5 feet high if not a working environment) adjacent to and accessible from BUYER'S home to ensure this dog's safety; and to provide adequate protection from excessive heat and cold. This dog shall be neither continuously tied nor allowed to roam at large.

BUYER agrees to provide proper training and socialization for this dog as stipulated by the Breeder for an Anatolian Shepherd Dog. Buyer agrees to enroll dog in a formal socialization class before the dog is six (6) months old. This can be obedience, conformation handling, or similar structured training classes for socialization. Schutzhunde training is NOT recommended for this breed! If Buyer trains or has this dog trained for the purpose of teaching dog to do bite work (i.e., schutzhunde, attack, police, dog fighting), all guarantees herein offered shall become null and void.

BUYER agrees to provide adequate veterinary care, including, but not limited to annual checkups including heartworm and fecal tests; to keep all immunizations current according to the guidelines as proscribed for Anatolian Shepherd Dogs; to properly administer heartworm and flea preventative if necessary; and to provide necessary medical treatment in the event of accident/injury to the dog.

BUYER agrees to feed a high quality dog food containing no corn, no wheat, no soy and no “meat by-products”, 22-26% protein and 12-15% fat levels. The only exception to this would be if BUYER is experienced in feeding a balanced raw diet to dogs.

BUYER and BREEDER agree to stay in contact with each other regarding this dog. All parties agree to keep each other notified of changes in location, email address and telephone numbers. BUYER agrees to send or email BREEDER at least one photograph of this dog every other month for the first year, and at least one photo every six months thereafter until dog reaches maturity (3 years for bitches; 4 years for dogs). If dog is microchipped, BREEDER should be listed as secondary contact in case owner cannot be contacted immediately.

BUYER agrees to pay **** and no/100 dollars ($*,***.00) for this Anatolian Shepherd Dog, THREE HUNDRED and no/100 dollars ($300.00) of which has already been remitted as a binder to reserve this pup. Remaining payment must be received in full by cash, bank check, wire transfer, or money order made payable to (“breeder”) by the time puppy is 8 weeks of age, prior to being picked up or shipped to BUYER.

Further contractual agreements:
----a. BUYER agrees to register this dog with the American Kennel Club within six months of receiving the “Registration Application” papers from BREEDER.
----b. BUYER also agrees to register this dog under the “ASIRI” kennel name, with “ASIRI" preceding the name chosen from the BREEDER’s approved list of names.
----c. BUYER agrees that BREEDER has the right to use any photos taken of this dog on BREEDER’S website or to be submitted for the advertising of BREEDER’s kennel.
----d. ALL transportation expenses are the responsibility of BUYER. Ground and air shipping is available; however, it is preferred that BUYER pick up the puppy in person.
----e. If BUYER elects to have their pup sent by air or ground transport, BUYER releases BREEDER of all responsibility for the pup at the time pup leaves BREEDER's care prior to transport. As the Buyer, I understand that it is my choice to have the dog shipped and that I am solely responsible for any problems incurred during shipping or after as a result of shipping.
